Terms of Use
These Terms of Use (“Terms”) form a legally binding agreement between you (“you”, “User”) and ZarGates Limited, a company incorporated under the laws of Hong Kong SAR with its registered office at Room 1401, 14/F, Chung Ying Building, 20 Connaught Road West, Sheung Wan, Hong Kong (“ZarGates”, “we”, “us”, “our”).
These Terms govern your access to and use of the ZarGates Telegram App (@ZARGatesBOT) and any associated Telegram mini apps, bots, widgets, quests, events, games, community features, marketplace features, referral features, subscription features, integrations, and related services we make available (collectively, the “Services” or “Platform”).
BY CLICKING “I AGREE”, OR BY ACCESSING OR USING THE SERVICES, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICES.

1.1 What ZarGates is. ZarGates is a gaming distribution and engagement platform that may include, depending on availability and jurisdiction: (a) access to games and game integrations, (b) quests, challenges, and events, (c) tournaments and leaderboards, (d) subscriptions and premium features, (e) marketplace, store, exchange and trading functionality, (f) referral and community growth mechanics, and (g) skill-based player-versus-player (“PvP”) formats where users may stake value against other users.
1.2 In-app acceptance. These Terms are designed for in-app presentation and acceptance. You may be required to scroll through these Terms before the “I Agree” button becomes available. Your acceptance is recorded for compliance and operational purposes.
1.3 Supplemental terms. Certain features, games, promotions, and integrations may be subject to additional terms, rules, or guidelines that will be presented in-app or made available via link (collectively, “Feature Terms”). Feature Terms form part of these Terms. If Feature Terms conflict with these Terms, Feature Terms govern only in relation to the relevant feature.
1.4 No obligation to provide features. We may add, remove, suspend, postpone, reschedule, or modify any feature, event, mechanic, reward structure, or integration at any time.
Capitalised terms have the meanings below unless the context requires otherwise:
“Account” means your ZarGates user account, typically linked to your Telegram identity and any associated identifiers.
“Affiliate” / “Partner” means a third-party studio, game, app, provider, or integration partner made available through the Services.
“Content” means any text, graphics, images, video, audio, software, data, information, or other materials made available through the Services, whether owned by ZarGates, Partners, or users.
“Digital Asset” means tokens, NFTs, in-app items, digital collectibles, credits, points, or other digital representations of value or utility used within or displayed in the Services.
“Feature Terms” means any additional rules or terms applicable to a specific feature, game, event, or promotion.
“Marketplace” means any in-app or integrated marketplace enabling transfers, trades, or transactions involving eligible Digital Assets or items, where available.
“Skill-Based Game” or “Skill Game” means a game or contest where outcomes are primarily determined by user skill rather than chance (including PvP formats).
“Wager” / “Stake” means any entry fee, buy-in, stake, wager, pot contribution, or other amount of value used to participate in a match, competition, or feature, where applicable.
“Telegram Stars” means Telegram’s proprietary payment/credit mechanism (where used for purchases or payments).
“Third-Party Services” means Telegram, TON wallets, payment processors, KYC providers, Partner games, blockchains, hosting providers, and other services not controlled by ZarGates.
“User Content” means anything you upload, post, submit, transmit, or make available through the Services, including usernames, avatars, messages, and media.
“Prohibited Conduct” means any prohibited behaviour described in these Terms.
3.1 Updates to Terms. We may update these Terms at any time. When we do, we will update the “Last Updated” date and may present updated Terms for acceptance in-app. Continued use of the Services after the updated Terms are posted or presented constitutes acceptance.
3.2 Platform changes. We may modify, suspend, or discontinue any part of the Services at any time, including games, events, integrations, rewards, mechanics, and access requirements.
3.3 Beta/experimental features. We may release beta or experimental features that may be incomplete or contain errors. Use is at your own risk.
4.1 18+ requirement. The Services are intended for users aged 18 or over. By using the Services, you confirm that you are at least 18 years old.
4.2 Legal compliance. You are responsible for ensuring your use of the Services (including any wagering or staking mechanics, if enabled) is lawful where you live. Access is void where prohibited.
4.3 Jurisdiction restrictions. We may restrict access based on jurisdiction, sanctions, compliance risk, Partner requirements, or legal obligations. We may block or limit certain features in certain locations at any time and without notice.
4.4 Verification. We may require identity, age, residency, sanctions screening, or KYC/AML checks for certain features. If you do not complete required checks, we may restrict, suspend, or terminate your access.
5.1 Account creation. To access certain features you may need to register an Account or connect identifiers such as an email address or wallet address.
5.2 One person, one Account. Unless we explicitly allow otherwise, you may maintain only one Account. Creating or using multiple accounts to gain advantage, evade restrictions, or manipulate the Services is prohibited.
5.3 Security. You are responsible for safeguarding your Account and any credentials, devices, private keys, or wallet access. We are not responsible for unauthorised access that is not caused by our systems.
5.4 Accurate information. If you provide information to us (including during verification), it must be accurate and current. Misleading information may result in restrictions, voiding of rewards, or termination.
6.1 General. The Services may include:
– game access and game integrations (including Partner games);
– tasks, quests, and challenges (daily/weekly or event-based);
– subscriptions and premium features (where offered);
– reward mechanics (including capped or limited rewards);
– referral programs (including multi-tier referral systems);
– marketplace features (including fees on trades);
– competitions, tournaments, and leaderboards;
– skill-based PvP formats (with optional stakes);
– integrations with Third-Party Services (including payment rails, wallets, or partner infrastructure).
6.2 No promise of availability. Not all Services are always available. We may pause or end a feature, event, or game for operational, legal, security, compliance, or commercial reasons.
7.1 Respect and good faith. You agree to act respectfully and constructively toward other users, Partners, moderators, and the ZarGates team.
7.2 Prohibited conduct (non-exhaustive). You must not engage in any of the following in any ZarGates-related space (including Telegram chats/channels/groups, in-app communications, community threads, or other spaces we operate or moderate):
(a) Harmful communications
– knowingly publishing or circulating false, misleading, or deceptive statements presented as fact about ZarGates, its products, Partners, team members, features, or community;
– intentionally spreading misinformation, rumours, or narratives designed to undermine confidence, deter participation, or damage the reputation of the Platform (“FUD”);
– deliberately misrepresenting platform mechanics, reward rules, payments, security, token-related plans, timelines, development status, or partner relationships;
– coordinating or encouraging others to do any of the above.
(b) Abuse and hostility
–harassment, bullying, threats, intimidation, hate speech, discrimination, or targeted abuse;
– obscene, violent, or illegal content.
(c) Disruption and manipulation
– spamming, flooding, or otherwise disrupting community discussions, events, or support channels;
– impersonation of ZarGates, team members, Partners, or other users;
– brigading, organised disruption, or coordinated attacks.
(d) Privacy and confidentiality
– doxxing, sharing private personal information, or publishing private communications or confidential information without consent.
7.3 Private support expectation. If you have an issue, complaint, or concern, you agree to raise it via our private support channels (e.g., official Telegram support) rather than disruptive public accusations.
7.4 Moderation and enforcement. We reserve the right to moderate community spaces and take action we consider appropriate to protect the community, including content removal, warnings, muting, restrictions, suspensions, and bans.
7.5 Discretionary bans for harm. Any communication or conduct that we, in our reasonable discretion, deem harmful to ZarGates, its users, its Partners, or the community (including misinformation, deliberate negativity campaigns, or abusive conduct) may result in an immediate ban, account suspension or termination and/or other enforcement actions under Section 19.
8.1 No cheating or automation. You must not cheat, exploit, collude, use bots, scripts, automation, macros, emulators, or any unauthorised methods to gain an unfair advantage, manipulate outcomes, farm rewards, or interfere with other users.
8.2 No exploit abuse. You must not exploit bugs, glitches, or unintended behaviours. If you discover an exploit, you must stop using it and report it promptly.
8.3 Fraud and manipulation. You must not commit fraud, engage in collusion, “win-trading,” match-fixing, value laundering, referral manipulation, or any behaviour intended to distort results or extract unfair value.
8.4 Investigations and remedies. Where we reasonably believe Prohibited Conduct has occurred, we may:
– investigate and request information;
– restrict or freeze access to features during investigation;
– void match results, leaderboards, or rewards;
– reverse or cancel rewards obtained through prohibited activity;
– suspend or terminate Accounts.
9.1 Skill-based activities. The Services may include Skill Games, tournaments, and PvP experiences. You acknowledge that outcomes are not guaranteed and may involve risk of loss.
9.2 Wagers and stakes. Some formats may allow users to stake value (fiat, Stars, stablecoins, tokens, or other permitted value) against other users. You participate at your own risk and are solely responsible for determining suitability and legality.
9.3 No house guarantee / no guaranteed outcome. Unless explicitly stated for a specific feature, ZarGates does not guarantee winnings, outcomes, prizes, or recovery of stakes.
9.4 Poker and similar formats. The Services may include poker or poker-like skill games. Where such features are provided using third-party products and infrastructure:
– the third-party provider may operate the servers, gameplay engine, billing, compliance/licensing, customer service, complaint handling, and dispute processes;
– your participation may be subject to additional third-party rules;
– ZarGates acts as a promoter and distributor and does not operate gambling services, unless explicitly stated in Feature Terms.
9.5 Responsible play. You agree to play responsibly. If you believe you may have an issue with wagering-style features, do not use them and seek appropriate support in your jurisdiction. We may implement optional limits or restrictions.
10.1 Virtual Items are licensed. Virtual Items and Digital Assets made available through the Services are provided as a limited, revocable licence to use within the Platform, unless required otherwise by applicable law. They may have no cash value and are not property rights.
10.2 Utility only; no equity rights. Where tokens or token-like items are used, they are intended for utility within the Platform and do not represent equity, voting rights, profit rights, or ownership interests in ZarGates or any Partner.
10.3 Volatility and loss risk. Digital Assets may fluctuate in value and may become illiquid or worthless. You accept the risk of volatility and loss.
10.4 Wallet and transaction responsibility. If blockchain features are enabled, you are solely responsible for wallet security, transaction approvals, and network fees. Blockchain transactions are typically irreversible.
10.5 Rewards and caps. Rewards may be capped, limited, or conditional. We may adjust reward structures, caps, eligibility criteria, distribution timings and mechanics at any time.
11.1 Referrals. Referral programs may include tiered benefits and eligibility criteria. We may modify or terminate referral programs and may disqualify suspicious referral activity.
11.2 Promotions and giveaways. Promotions (including giveaways, prize pools, airdrops, quests, and challenges) may have separate rules, eligibility criteria, and may be modified or cancelled if required for fairness, integrity, compliance, legal risk, or operational reasons.
11.3 Competitions and leaderboards. Competitions may be subject to additional rules regarding scoring, tie-breakers, eligibility, disqualification, and fraud prevention.
11.4 Disqualification. We may disqualify users and void results where we reasonably believe Prohibited Conduct occurred.
12.1 Payment methods. Payments may be made via Telegram Stars, fiat, stablecoins (e.g., USDT/USDC), or other methods offered in-app, depending on location and feature availability.
12.2 Third-party billing. Billing may be handled by Third-Party Services. We are not responsible for outages or errors caused by third-party payment rails.
12.3 No refunds (general). Unless required by applicable law or expressly stated in Feature Terms, all purchases are final and non-refundable.
12.4 Chargebacks and reversals. Chargebacks, reversals, or suspected fraud may result in Account restrictions, reversal of benefits, or suspension pending investigation.
13.1 No financial advice. Nothing in the Services constitutes financial advice, investment advice, legal advice, or a recommendation.
13.2 No profit/ROI guarantee. We do not guarantee profits, returns, outcomes, token appreciation, rewards value, or any economic gain.
13.3 No reliance on timelines. Any roadmap statements, estimated timelines, release windows, event schedules, listings, or token-related plans are subject to change and do not constitute binding commitments. We may delay, reschedule, postpone, or cancel at our discretion.
14.1 As-is / as-available. The Services are provided “as is” and “as available” without warranties to the maximum extent permitted by law.
14.2 Maintenance and downtime. We may suspend Services for maintenance, upgrades, investigations, or security incidents.
14.3 Errors and corrections. If an error, bug, malfunction, exploit, interruption, or miscalculation results in incorrect rewards, balances, match outcomes, leaderboards, or payouts, we may, acting reasonably:
– correct the error;
– void affected results or transactions;
– reverse erroneous credits or rewards;
– suspend the affected feature during investigation.
14.4 User obligations. If you become aware of an error or suspect one, you must stop using the affected feature and report it promptly.
15.1 User Content licence. By submitting User Content, you grant ZarGates a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, adapt, and distribute that content as needed to operate, promote, and improve the Services.
15.2 Username and avatar rules. You must not use usernames or avatars that are illegal, hateful, pornographic, threatening, deceptive, or impersonating. We may remove or replace content and apply enforcement actions.
15.3 Content removal. We may remove User Content at any time for moderation, legal, compliance, or safety reasons.
16.1 ZarGates IP. All rights, title, and interest in the Services, software, branding, designs, logos, and Platform content belong to ZarGates or its licensors.
16.2 Limited licence to you. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes, subject to these Terms.
16.3 Restrictions. You must not copy, reverse engineer, scrape, exploit, resell, or create derivative works of the Services except as permitted by law.
16.4 Brand usage. You must not use ZarGates trademarks or branding in a misleading, defamatory, or unauthorised manner. Commercial use requires our prior written consent.
17.1 Partner games. Partner games may be operated by third parties. ZarGates may act as a distribution layer, engagement layer, or infrastructure provider depending on the arrangement.
17.2 Third-party terms. Your use of Third-Party Services is subject to their terms and policies. We do not control Third-Party Services and are not responsible for their outages or failures except as required by law.
17.3 External links. External links are provided for convenience. We are not responsible for third-party content.
18.1 Privacy policy. Your use of the Services is governed by our privacy policy where provided.
18.2 Partner data responsibility. Where you interact with Partner games or Partner services, the collection and storage of user personal data may be conducted by and remain the responsibility of the Partner, governed by the Partner’s privacy policies and applicable law. ZarGates is not responsible for Partner-side data handling.
18.3 Analytics. We may use aggregated or anonymised analytics to improve the Services.
19.1 Termination by you. You may stop using the Services at any time. Stopping use may result in loss of access to features, progress, and certain benefits.
19.2 Suspension/termination by us. We may suspend, restrict, or terminate your Account or access to some or all Services at any time if we reasonably believe you have violated these Terms, violated applicable law, created risk, harmed the community, or engaged in Prohibited Conduct. This includes communications or conduct we deem harmful to the community or the project under Section 7.
19.3 Effects of termination. Termination may result in loss of access, progress, rewards, and Virtual Items, subject to applicable law. We may also void results or reverse rewards obtained through Prohibited Conduct.
20.1 No warranties. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied.
20.2 No guarantee of profit. We do not guarantee profit, ROI, reward value, token appreciation, or any timeline.
20.3 Third-party risk. You accept risks arising from Third-Party Services, including outages, payment failures, wallet issues, and partner issues.
21.1 Excluded damages. To the maximum extent permitted by law, ZarGates will not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, goodwill, or business.
21.2 Liability limits where exclusion not permitted. Where liability cannot be excluded under mandatory law, it will be limited to the minimum extent permitted and applied only to direct losses caused by ZarGates.
21.3 Consumer rights. Nothing in these Terms limits your rights under mandatory consumer protection laws that cannot be excluded.
You agree to indemnify and hold harmless ZarGates, its directors, officers, employees, contractors, and Partners from claims, losses, liabilities, damages, and expenses arising from:
– your breach of these Terms;
– your misuse of the Services;
– your violation of law;
– your User Content;
– or your Prohibited Conduct.
You are solely responsible for determining and paying any taxes applicable to your activity, including rewards, winnings, transactions, or transfers.
We are not liable for any failure or delay caused by events beyond our reasonable control, including network failures, Telegram outages, blockchain disruptions, payment processor failures, legal/regulatory changes, sanctions, war, civil unrest, acts of government, or natural disasters.
25.1 Governing law. These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR.
25.2 Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, including breach, termination, or invalidity, shall be finally settled by arbitration in Hong Kong under the Hong Kong International Arbitration Centre (“HKIAC”) Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The arbitration shall be conducted in English by a single arbitrator. The award shall be final and binding.
25.3 Interim relief. Nothing prevents either party from seeking urgent interim relief in any competent court where necessary.
26.1 Entire agreement. These Terms and any Feature Terms constitute the entire agreement between you and ZarGates regarding the Services.
26.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
26.3 No waiver. Our failure to enforce any right is not a waiver.
26.4 Assignment. You may not assign these Terms. We may assign these Terms in connection with a corporate restructure, merger, acquisition, or sale of assets.
26.5 Language. If translations are provided, the English version prevails in case of conflict.
